STATEMENT
OF POLICY - STANDARD OF PRACTICES
The Mid Island
Construction Association is committed to promoting open competition
within the marketplace and specifically as it relates to the purchase
of construction services, goods and technology. The Mid Island Construction Association
recognizes and endorses the need for establishing practical guidelines
in the form of prescribed principles of standard practice which
all components of the construction industry may voluntarily accept
and apply in their sector of the marketplace. This "Statement
of Policy - Standard Practices" is The Mid Island Construction Association's expression
of support for the foregoing.
All publicly
funded projects or construction service requirements should be
subjected to open competitive tender.
The Mid Island Construction Association
endorses the "Code of Practice - Publicly Funded Construction
Projects" as established by the British Columbia Construction
Association.
The Mid Island Construction Association
endorses and actively promotes use of the Provincial Bid Depository
System.
The Mid Island Construction Association
endorses the use of "Guide to Construction Tendering Procedures"
as published by the Canadian Construction Documents Committee.
The Mid Island Construction Association
endorses and recommends when ever possible the use of the Procedures
and Guidelines document, produced by the Public Construction Council
of British Columbia.
The Mid Island Construction Association
endorses the principle that following the close of tenders, consideration
of award should be to the lowest qualified bidder who has fulfilled
all requirements of the prescribed tender documents including
provision of qualifications and experience if required.
The Mid Island Construction Association
endorses the principle that should negotiation of changes be required,
such negotiation shall be carried out between the owner, his agent
and only the selected successful bidder and his named sub-bidders.
The Mid Island Construction Association
endorses the use of recognized industry standard contract forms
depending upon the chosen method of contractual relationship -
lump sum, fixed price, unit price - etc.
The Mid Island Construction Association
condemns matters such as bid shopping, private tender openings, non-disclosure of tender results, awards to non-bidders and other similar practices.
The Mid Island Construction Association
emphasizes the importance of expediting cash flow through the
contractual chain and underlines the necessity for all involved
to meet commitments in a timely manner as dictated by contractual
terms.
The Mid Island Construction Association
recommends that wherever possible recognition of membership in
our Association should be given consideration within the contractual
chain.
The stability
and continuance of supporting financial commitments for the project
and further; The Mid Island Construction Association emphasizes that tenders should not
be called nor negotiations undertaken until this financial stability
can be so demonstrated.
That when
The Mid Island Construction Association receives a written complain from either inside or outside the membership, the subject of which can be identified within the "Standard Practice - Statement of Policy", then this shall be referred to the B.C.C.A.-V.I. Executive Committee; who, upon confirming a breach, may recommend to the Board of Directors letters of censure to the offending parties.
CODE OF ETHICAL CONDUCT
MEMBERS
OF THE Mid Island Construction Association believe that business
standards of a high order are essential to progress and will better
qualify us to service society our industry and Association by
adopting the following Code of Ethics
Members of The Mid Island Construction Association shall take on a professional
responsibility with all business functions founded on trust, and
every transaction to which they are a party to shall be conducted
with honour and integrity
Members of The Mid Island Construction Association shall promote action, which will prove
to be beneficial to the public interest and in the best interests
of the construction industry as a whole.
Members of The Mid Island Construction Association shall maintain a high level
of quality in both material and workmanship thereby providing
the best possible service to our clients.
Members of The Mid Island Construction Association shall abide by all applicable
laws, codes regulations and standard practices to safeguard our
industrys performance for the protection of public health
and the environment.
Members of The Mid Island Construction Association shall firmly stand by the principle
that all contracts, whether written or oral, be performed with
the same good faith and intent with which the parties entered
the agreement and any disagreements should be resolved by negotiation
or arbitration in preference to legal action.
Members of The Mid Island Construction Association shall promote fairness in dealing
with their employees, treating them with respect and assisting
and encouraging their intellectual and skill development.
Members of The Mid Island Construction Association shall support and shall encourage
their peers to support the policies and objectives of The Mid Island Construction Association,
locally, provincially and nationally
